The Compliance Landscape
HR compliance in India spans multiple laws governing wages, contract labour, gratuity, social security and working conditions. Non-compliance can result in penalties, disputes and reputational damage.
Employers must maintain proper records, registrations and statutory registers, and file returns on time.
Contract Labour
The Contract Labour (Regulation and Abolition) Act requires establishments above certain thresholds to register, and contractors to obtain licensing. Violations attract penalties.
Using a compliant contract staffing provider shifts much of this responsibility to the provider, who maintains registrations and records.
PF, ESI & Other Deductions
Employers must deduct and remit Employees' Provident Fund (PF) and Employees' State Insurance (ESI) where applicable, along with professional tax. Timely, accurate compliance is critical.
The New Labour Codes
India's four new labour codes — on wages, industrial relations, social security and occupational safety — consolidate existing laws. Employers should prepare for the transitions they introduce.
